Thank you for visiting and using Blimey. We are excited and glad you are here, but there are some terms you need to agree to before you use our website and services (“Services”).

These Terms of Use (“Terms”) govern the usage of Blimey, a learning platform and desktop application designed for Persons with Visual Impairment (PwVI) to acquire computer and software application skills through trainer-led and self-driven exercises with built-in automated feedback. It is an initiative of EnAble India, a non-profit organization having its registered office at Bengaluru, Karnataka, India. Users of Blimey can download the application from the web at www.blimey.live and access learning content on the desktop application upon installation on their respective systems.

By using Blimey, you have accepted and agree to be governed by these Terms, as may be amended from time to time. The terms “you”, “your” hereinafter refer to anyone who downloads or registers on Blimey, or accesses, views or uses the Website, and the terms “we”, “us”, or “our” refer to EnAble India.

1. Definitions

  • “Administrator” means a Registered User who is authorized by EnAble India to view, create, modify, and delete user accounts, and create category Database Tools.
  • “Blimey” means the learning platform and desktop application designed for Persons with Visual Impairment (PwVI) to acquire computer and software application skills, is an initiative of EnAble India, is accessible online at www.blimey.live (the “Website”) and the desktop application, and includes other sub-domains / extended domains of Blimey.
  • “Candidate” means a Registered User who registers as a student on Blimey to perform exercises and complete tests on Blimey.
  • “Content” means and includes, as the context requires, (i) any text, scripts, graphics, photos, sounds, music, videos, audio-visual combinations, interactive content, features and other materials you may view, access or contribute, (ii) all content and postings that are written, uploaded, submitted, stored, sent, received, shared or otherwise provided by Registered Users, and (iii) all types of learning material used by a Registered User.
  • “Publisher” means a Registered User who is authorized by EnAble India to act as a content creator who can create, upload, modify, or delete Content on Blimey.
  • “Registered Users” refer to a natural person who registers themselves on Blimey in accordance with the requirements of Blimey.
  • “Trainer” means a Registered User who is authorized by EnAble India to assign exercises to Candidates, provide feedback, and access their reports.

2. Users of Blimey

  • You represent and warrant that you are of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use Blimey).
  • If you are agreeing to these Terms of Use on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms of Use on that organization or entity’s behalf.

3. Electronic Communication

  • When you use Blimey or send emails or other data, you consent to receive communications via electronic records from us as and when required.
  • Service of Notice: Your registration data and email ID will be construed as Your ‘designated electronic address’.
  • By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by various policies provided on the Blimey Website.

4. Your Privacy and Personal Information

  • We take the privacy of our users very seriously. Please review the entire Privacy Policy of Blimey.
  • By using Blimey and/or by providing your information, you consent to the collection and use of the information you disclose on Blimey.

5. Access and Use

  • As a visitor of the Website, you are free to access, view and use the Website subject to these Terms of Use.
  • To access Blimey course materials as a Candidate, you are required to download the application from www.blimey.live, install it on your Windows PC, and register.
  • Registration and use of Blimey is provided to you free of cost.
  • You promise to only use Blimey for your personal use and use as allowed by the Terms of Use and Content License.
  • Any violation of the Terms of Use by anyone using Blimey under Your Account may be deemed a violation by You.
  • We make no guarantee as to the continuous uptime and availability of Blimey.

6. User Registration

  • You are responsible for maintaining the confidentiality of your User Name and Password.
  • You may not transfer your Account to anyone else without our prior written permission.
  • You hereby grant us a non-exclusive, worldwide, perpetual right to exercise the copyright, publicity, and database rights you have in Your information.

7. Rules Governing Use of Content and Intellectual Property

  • Blimey Content: Blimey contains Content owned by Enable India or its licensors. EnAble India owns and retains all proprietary and intellectual property rights in and to the Content.
  • Content License: Content published on Blimey is licensed in accordance with the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License. Contact us at contribute@blimey.live for assistance.
  • Software: We grant you a limited, personal, non-exclusive and non-transferable license to use the Software solely for your personal use.
  • We reserve the right to remove any published Content from Blimey at any time, without notice.

8. Prohibited Content and Use

  • You won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you.
  • You won’t modify, publish, transmit, or create derivative works based on Blimey other than as specifically allowed by the Creative Commons License.
  • You agree that you will not use Blimey to scrape or attempt to scrape any Content.
  • You shall not use Blimey for any illegal purpose, distribute defamatory content, infringe upon third-party rights, or disseminate malicious code.

9. Takedown Policy and Queries

  • We may at our sole discretion delete, remove, or disable access to your information to comply with Indian laws (including the Information Technology Act, 2000).
  • If you find any content to be offensive or in violation of applicable laws, submit your feedback to management@blimey.live.

10. Warranty Disclaimer & 11. Limitation of Liability

THE SERVICES, CONTENT, WEBSITE, AND ANY SOFTWARE ARE PROVIDED ON AN “AS-IS” BASIS, WITHOUT WARRANTIES OF ANY KIND. Under no circumstances shall we be liable to you or to any other person for any indirect, special, incidental, or consequential damages.

12. Indemnification & 13. Jurisdiction

You agree to indemnify and hold EnAble India harmless for any claims arising from your use of Blimey. These Terms of Use are governed by the laws of the Republic of India, with exclusive jurisdiction in the courts located in Bengaluru, Karnataka.

14. Electronic Agreement & Grievance Officer
